Kolday Terms of Use
Effective date: 22 October 2026
These terms are an agreement between you and Yinon Perets ("we") about the Kolday app. By using the app you accept them. Our Privacy Policy explains how your data is handled. Apple's Licensed Application End User License Agreement also applies to the app; if it conflicts with these terms, these terms apply to the extent the law and Apple's rules allow.
1. What Kolday is
Kolday is a personal voice journal. You record short voice notes; the app turns them into text and, if you agree, creates AI analyses (mood, topics, ideas, a summary, tasks) and weekly or monthly summaries.
2. Not medical advice
Kolday is a journal, not a medical, psychological or diagnostic tool. AI output is generated automatically, may be wrong, incomplete or misleading, and is not medical, psychological, therapeutic, legal or financial advice. Do not rely on it for decisions about your health or safety. Talk to a qualified professional about those.
Subscriptions tracker. The Subscriptions screen is a personal reminder tool, not financial advice. The names, amounts and renewal dates are what you enter, so check them against your own bills. Reminders are local notifications that depend on your iPhone's settings (for example, notifications allowed for Kolday), and we do not guarantee that a reminder will arrive. Kolday does not cancel anything for you: cancelling a subscription is done with the service itself.
If you are in danger or thinking about harming yourself or others, contact your local emergency services now (for example 911 in the US, 101 or 1201 (ERAN) in Israel, 112 in the EU). Kolday does not monitor your entries and cannot respond to emergencies.
3. Your account
You need an account (sign-in by email link or with Apple) to sync entries, use AI analysis and subscribe. Keep access to your email account safe. You must be at least 16 years old. You can delete your account anytime in Settings > Delete account.
Your optional profile (display name, avatar and About-you text) is visible only to you. It must not impersonate anyone else or contain unlawful content.
4. Your content
Your recordings, transcripts and entries belong to you. You give us only the permission needed to store, process and show them to you, and to send them to the processors described in the Privacy Policy, so the app can work. We do not use your content for advertising. AI analyses are generated for you; you may use them as you like. When you use Send summary or another share action, the text goes only to the app you pick in the iPhone share sheet, under that app's own terms; we do not receive or keep it.
5. Plans and subscriptions
- Free: [OWNER-FILL: confirm] 10 AI analyses and 10 journal questions per calendar month (UTC), counted on our server. The Free plan shows a banner ad (Google AdMob, non-personalized; see the Privacy Policy, section 12). Ads are never shown on the recording screen or inside an entry.
- Kolday Pro: an auto-renewable subscription (monthly or yearly) bought through Apple In-App Purchase. It includes no ads, up to 300 AI analyses and 600 journal questions per calendar month (UTC) on our server (if you reach a cap, that feature resumes at the start of the next month; analyses and questions handled on your iPhone or with your own key don't count toward these limits), recordings up to 5 minutes per entry (Free: 60 seconds), cloud transcription of your recordings through our server by OpenAI, up to 300 minutes per calendar month (UTC) (only after you accept the AI consent; past the cap, or when cloud transcription isn't possible, your iPhone transcribes the recording itself), every recording template (Free: free talk and gratitude), mood by day of the week on the Insights tab, extra accent colors for the app (Free: cobalt), read-aloud of your summaries with the iPhone's built-in voice, monthly summaries and a yearly review, chat history saved on your device, cloud backup of your recordings, and tracking unlimited subscriptions in the Subscriptions screen, with a summary of what you saved by cancelling (Free: up to 3 active ones, with reminders). Exporting your journal as plain text is free on every plan. [OWNER-FILL: confirm the Pro feature list matches the paywall at release.]
- Prices are shown in the app before you buy and come from the App Store.
- Free trial: a free trial may be offered; its length and eligibility are shown in the app before you subscribe. If you don't cancel at least 24 hours before the trial ends, the subscription starts and is charged.
- Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period; your account is charged for renewal within the 24 hours before the period ends.
- Manage or cancel in iPhone Settings > Apple ID > Subscriptions. Deleting the app or your Kolday account does not cancel the subscription.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com).
- Your own API key (BYOK): you may add your own API key from Anthropic or OpenAI instead. Then entry analyses are sent directly to that provider under your own agreement with it and at your own cost; we are not responsible for charges on your key. If you save an OpenAI key, it is also used to transcribe a recording your iPhone can't transcribe (only after you accept the AI consent): the audio goes directly from your iPhone to OpenAI, under your own agreement with OpenAI and at your own cost, not through our server. BYOK does not unlock Pro features.
- On-device analysis: on a supported iPhone with Apple Intelligence, entries in a language Apple's model supports (currently English, not Hebrew) can be analyzed on the iPhone at no cost. Results from Apple's smaller model may be less detailed than server analysis.
6. Acceptable use
Do not:
- use the app to break the law or to record other people without the consent the law requires;
- try to access other users' data, attack, overload or reverse-engineer the service or its servers, or get around usage limits;
- use the app to generate content that is illegal or abuses others;
- resell or offer the service to others.
6a. Shared folders
Shared folders ("Sharing Thoughts") are not offered in this release of the app.
7. Availability and changes
The app depends on third-party services (Apple, Supabase, Anthropic and RevenueCat, and OpenAI for Kolday Pro cloud transcription and through your own API key). Features may be unavailable at times, and we may change or remove features. We will try to give notice of material changes.
Links to other websites. The "Links" in an entry's Actions (for cancelling a service or shopping for a product) are convenience suggestions. They come from an AI analysis, which may be wrong, so check them before you rely on them. The websites, stores and apps they open are not ours: we are not affiliated with them, earn no commission from them, and do not guarantee that a page is current, that a service can be cancelled there, or any price or availability. What you do on those sites (for example cancelling a subscription or buying something) is between you and them, under their own terms, and is your responsibility.
8. Termination
You can stop using the app and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, or if required by law; where possible we will tell you first. Sections 2, 9, 10 and 11 continue after termination.
9. Disclaimer
The app is provided "as is" and "as available". To the extent the law allows, we make no warranties that it will be error-free, uninterrupted or that AI output will be accurate. Keep your own copies of anything important (anyone can export the journal as text in Settings > Privacy & security).
10. Limitation of liability
To the extent the law allows, the app is provided without any guarantee, and we are not liable for indirect, incidental or consequential damages, loss of data, loss of profit, or decisions you make based on AI output. Our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law (for example for fraud or gross negligence) or the mandatory consumer rights you have where you live.
11. Governing law
These terms are governed by the laws of the State of Israel, and disputes go to the courts of Tel Aviv-Jaffa, unless the mandatory consumer law of your country gives you other rights.
12. Changes to these terms
We may update these terms. The effective date at the top shows the latest version. If a change is material, we will notify you in the app or by email before it applies. Continuing to use the app after that means you accept the new terms.
